KiTraining terms of service

These Terms of Service (“Terms”) govern access to and use of KiTraining, including the website https://kitraining.app, the application at https://app.kitraining.app, and related services (together, the “Service”).

By creating an account, accessing, or using KiTraining, you agree to these Terms and our Privacy policy. If you do not agree, do not use the Service.

1. Description of the Service

KiTraining is a training platform for hybrid athletes and coaches. Among other features, it lets you:

• Plan and log running, strength, and other training sessions.
• Review progress, body weight, and training metrics.
• Use coach mode to assign and review athlete work.
• Optionally connect third-party services (for example Google Health / Google Fit, Strava, or Concept2) to sync activity.

The Service may evolve: we may add, change, or remove features, plans, or integrations to improve the product or for technical, legal, or security reasons.

2. Eligibility and accounts

• You must be at least 16 years old to use KiTraining.
• You are responsible for the accuracy of your account information and for keeping your credentials confidential.
• We may suspend or close accounts that violate these Terms, are fraudulent, or endanger the Service or other users.

3. Acceptable use

You agree not to:

• Use the Service unlawfully, abusively, or in ways that infringe others’ rights.
• Attempt unauthorized access to systems, other accounts, data, or non-public areas.
• Interfere with the Service (attacks, abusive scraping, overload, malware).
• Upload unlawful, defamatory, privacy-invasive, IP-infringing, or otherwise inappropriate content for a training environment.
• Resell, sublicense, or commercially exploit the Service beyond what is expressly allowed, except under a written agreement.

4. Coach–athlete relationships

When a coach and an athlete establish a relationship in the product, each party is responsible for the data and content they share in that context. KiTraining provides the tool; it is not a party to the professional relationship and does not guarantee training outcomes.

5. Third-party integrations

Integrations are optional. By connecting an external provider, you also become subject to that provider’s terms and policies. KiTraining does not control the availability, accuracy, or continuity of third-party APIs. You may disconnect an integration at any time from Service settings or the provider.

Processing of data related to these connections is described in the Privacy policy, including Google’s Limited Use requirements where applicable.

6. User content

You retain rights to content you submit to KiTraining (workouts, notes, profile images, etc.). You grant us a limited, non-exclusive, worldwide license to host, process, and display that content solely as needed to operate and improve the Service.

You represent that you have the right to submit that content and that it does not infringe third-party rights.

7. KiTraining intellectual property

The software, design, trademarks, text, logos, and other Service elements (excluding your content) are owned by KiTraining or its licensors. These Terms do not transfer ownership; they only grant a limited, revocable, non-exclusive right to use the Service while you comply with these Terms.

8. Plans, pricing, and payments

Some features may be free and others paid. If you purchase a paid plan, the price, billing, and cancellation terms shown at purchase or on the pricing page apply. We may change prices or plans with reasonable notice where permitted by law.

9. Health disclaimer (not medical advice)

KiTraining is not a medical device and does not replace a healthcare professional’s judgment. Any training information or recommendations (if provided) are general and informational. Before starting or changing an exercise program, consult a physician, especially if you have injuries, medical conditions, or are pregnant.

You use the Service at your own risk. To the fullest extent permitted by law, KiTraining is not liable for injuries, damages, or losses arising from physical exercise or decisions made based on Service information.

10. Availability and support

We work to keep the Service available and secure, but we do not guarantee uninterrupted, error-free operation or compatibility with all devices. Support is provided via info@kitraining.app to a reasonable extent given our resources.

11. Disclaimer of warranties

Except where mandatory law provides otherwise, the Service is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Limitation of liability

To the fullest extent permitted by applicable law, KiTraining and its collaborators will not be liable for indirect, incidental, special, consequential, lost profits, data loss, or business interruption damages arising from use of or inability to use the Service.

Our aggregate liability for claims related to the Service will not exceed the greater of: (a) the amount you paid KiTraining for the Service in the 12 months before the claim, or (b) fifty euros (€50), except for willful misconduct or gross negligence where liability cannot be limited by law.

13. Indemnity

You agree to indemnify KiTraining against third-party claims arising from your misuse of the Service, your content, or your breach of these Terms, to the extent permitted by law.

14. Suspension and termination

You may stop using the Service and request account closure at any time. We may suspend or terminate access if you breach these Terms, if required by law, or if needed to protect the Service or other users. After termination, your right to use the Service ends; provisions that by nature should survive (IP, limitations, governing law, etc.) remain in effect.

15. Changes to these Terms

We may update these Terms. The current version will be posted on this page with its update date. Continued use after changes take effect constitutes acceptance, unless law requires specific consent.

16. Governing law and jurisdiction

These Terms are governed by Spanish law. Except where mandatory consumer rules provide otherwise, the parties submit to the courts of the Service operator’s domicile in Spain.
